INTRODUCTION 

This privacy policy sets out how FMC uses and protects any information that you give FMC when you use this website.

FMC Talent is committed to protecting the privacy and security of the personal data we collect and ensuring we comply with our obligations under the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018. 

We are registered with the UK supervisory authority, Information Commissioner’s Office (“ICO”) in relation to our processing of Personal Data under registration number Z8585261. Unless we notify you otherwise, we are the controller of the personal data we process about you. This means that we decide what Personal Data to collect and how to process it.

The purpose of this privacy notice is to explain what personal data we collect about you and how we process it. This privacy notice also explains your rights, so please read it carefully. If you have any questions, you can contact us using the information provided below under the ‘How to contacting us’ section.

WHAT DATA WE COLLECT 

Candidate data 

When collecting data from you regarding your interest in a position, we need to process certain categories of personal information to understand your ambitions, skills and knowledge. Such categories of personal data may include your: 

  • Name 
  • Email address
  • Phone numbers
  • Other contact details
  • Education details
  • Employment history 
  • Salary and other remuneration information 
  • Personal circumstances related to work 
  • Extra information you choose to tell us about you 
  • IP address 
  • Personal/Work related interests that you disclose to us during our relationship
  • Information relating to your status at your current work/employment including related benefits and obligations 
  • Health, visa and diversity information – in accordance with laws and requirements 

Client related data 

If you’re a customer of FMC or you are enquiring about becoming one, there is certain information we need to know about you as a contact, such as your: 

  • Name
  • Email address 
  • Phone numbers 
  • Over the course of our relationship with you, we may also collect and process further categories of personal data including your: 
  • Finance team’s contact details 
  • The skills and qualifications you require of your existing and prospective employees

Supplier data 

We will collect the following categories of personal data relating to our suppliers to enable us to manage our relationships and communicate effectively: 

  • Name
  • Email address
  • Phone numbers
  • Bank or payment details 

Reference data 

Candidates may provide us with the personal data of references in order for us or our clients to gather more information about our candidates. If your personal data has been provided to us by a candidate, we will store a small amount of information about you. This data is usually limited to your name and contact information. This information will be used to initially contact you. We may then seek further information from you after this. We will not hold your information for more than one month without providing you with our privacy notice.

Marketing data 

From time to time, we collect information for market research directly from an individual. Data such as this is stored and can include:

  • Views and opinions on market trends and changes in your industry

In addition, we may reach out to prospective clients to discuss the services we can provide your organisation. We use your email or phone number to do this.

HOW WE COLLECT YOUR DATA

Whether you are a candidate, client, supplier or reference, we will collect your personal data through one of the following channels: 

  • Directly from you, over the phone or via internet phone or video call
  • Directly from you, face to face
  • Directly from you, over email or mail communication 
  • From third party job websites such as Reed or Indeed 
  • From third party social websites such as LinkedIn 
  • From the FMC website – when a form is completed 
  • From the FMC website – based on your activity 
  • From other individuals you know, who refer you to us or provide your details as a reference
  • Through publicly accessible sources such as your website or social networks

This data is stored in a secure system and cleansed regularly. At any time, your data can be requested or removed from the FMC system. 

HOW WE USE YOUR DATA & THE LAWFUL BASIS WE RELY ON

Candidate data 

We will use your data to find you a new job or understand your position in the market and help you achieve the next step in your career. We may contact you by email, phone, fax or mail in order to do this. We may also use your job search related information to profile the market and for market research. 

In order to perform this processing, we rely on the lawful basis of our legitimate interests in providing our services to you. Where we collect special category data in the performance of these services, we will seek your explicit consent. We will also seek your consent before sharing any of your data with prospective employers.

In addition, should FMC be subject to any statutory obligations, we will rely on the lawful basis of fulfilling our legal obligations. Should FMC enter into a contract with you, we will rely on the lawful basis of performance of a contract to undertake our obligations.

At present, all our recruitment activities involve human decision making during the process. Should we ever decide to have automated technologies in the future that make decisions around your application to a job or suitability for a job, we will update this policy to say as such. 

Client related data 

The main reason for us to use client data is to ensure relationships run smoothly. We will use the information you give us as a client to give you a bespoke service and identify candidates that are right for your organisation. When we do this, we rely on the lawful basis of our legitimate interests in managing our client relationships.

Sometimes we may ask you for your consent to provide further information to allow us to carry out market research.

Supplier data 

The reasons we use personal data of our suppliers are to manage our business relationships, ensure the contractual arrangement between us runs smoothly and to ensure compliance with legal requirements. We rely on the lawful basis of our legitimate interests in managing our supplier relationships.

Reference information 

We use the personal data of references to assess whether a candidate is right for a job. When your data is initially collected, we rely on the basis of our legitimate interests in assisting our candidates. Once you have been contacted, we will seek your consent to process further personal data.

Marketing data 

We may gather insights and knowledge from both candidates and clients to be used as marketing data for reports and news production. Your consent will be sought at the time your personal data is collected and you will be contacted with the results of the marketing data gathered. Most of the time this information is then aggregated or anonymised, so no personal information is identifiable. At this point the aggregated or anonymised information will be used by us without further notice to you.  

Where we contact you as a prospective client, we do so on the basis of our legitimate interests in contacting organisations who we believe would benefit from the services we provide. 

SHARING YOUR PERSONAL DATA

For some business activities we share your personal data with our carefully selected vendors and third-party service providers, for instance, to store data on our behalf. In addition, we may also share your personal data for the purposes outlined below:

Candidate data 

Primarily, we will only share your information with prospective employers, once your permission has been given. We may also share your data with third parties where we are subject to a legal obligation or to defend legal claims. 

Client related data 

Your personal data will remain with FMC and not shared with third parties outside of the service providers mentioned above. We may however share your contact information with a prospective candidate if we believe they are suitable for a role. 

Supplier data 

We may occasionally share your information with third parties such as other service providers and organisations. 

Reference information 

Your personal data may be shared with our clients where they complete the reference checks on candidates.  

INTERNATIONAL DATA TRANSFERS  

FMC provide recruitment services globally and so for us to continue operating in this way, we may have to transfer your data internationally. This is because both the organisations we use to provide our service to you are based outside the UK or, if you are a candidate, we may transfer your data to potential employers based internationally. 

  • Where personal data is transferred outside the UK, we have taken appropriate steps to ensure that an essentially equivalent level of protection to that guaranteed in the UK is provided. We do this by ensuring that:
  • Your Personal Data is only processed in a country which the Secretary of State has confirmed has an adequate level of protection (an adequacy regulation), or

Your data will always be transferred in a way that is secure.  You will always know which prospective employers we are sharing your information with.  We will gain your consent before your details are shared with a prospective employer.

SAFEGUARDING YOUR DATA 

We are committed to ensuring your data is secure, in order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect online. 

HOW LONG DO WE KEEP YOUR DATA FOR?

We will not keep your personal data any longer than is necessary for the purposes described above. Alternatively, in some circumstances, your personal data can be deleted upon request.

If we have not had meaningful contact with you for a period 5 years, we will delete your personal data from our systems unless we believe that we should lawfully preserve it (for example, because of our obligations to tax authorities or in connection with any anticipated litigation). 

When we refer to “meaningful contact”, we mean communication between us (either verbal or written). We will consider it meaningful contact with us if you have submitted your CV to us, communicated with us about potential roles, communicated with us about the potential of working together or clicked through on our marketing communications. 

YOUR RIGHTS

You have certain rights in relation to the processing of your Personal Data, including to:

Right to be informed

You have the right to know what personal data we collect about you, how we use it, for what purpose and in accordance with which lawful basis, who we share it with and how long we keep it. We use our privacy notice to explain this.

Right of access (commonly known as a “Subject Access Request”)

You have the right to receive a copy of the Personal Data we hold about you.

Right to rectification 

You have the right to have any incomplete or inaccurate information we hold about you corrected.

Right to erasure (commonly known as the right to be forgotten)

You have the right to ask us to delete your Personal Data.

Right to object to processing

You have the right to object to us processing your Personal Data. If you object to us using your Personal Data for marketing purposes, we will stop sending you marketing material. 

Right to restrict processing

You have the right to restrict our use of your Personal Data. 

Right to portability

You have the right to ask us to transfer your Personal Data to another party.

Automated decision-making. 

You have the right not to be subject to a decision based solely on automated processing which will significantly affect you. We do not use automated decision-making in any of our current processes.  

Right to withdraw consent

If you have provided your consent for us to process your Personal Data for a specific purpose, you have the right to withdraw your consent at any time. If you do withdraw your consent, we will no longer process your information for the purpose(s) you originally agreed to, unless we are permitted by law to do so.

How to exercise your rights

You will not usually need to pay a fee to exercise any of the above rights. However, we may charge a reasonable fee if your request is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances. 

If you wish to exercise your rights, you may contact us using the details set out below within the section called ‘Contacting Us’. We may need to request specific information from you to confirm your identity before we can process your request. Once in receipt of this, we will process your request without undue delay and within one month. In some cases, such as with complex requests, it may take us longer than this and, if so, we will keep you updated.

CONTROLLING YOUR PERSONAL INFORMAITON 

We will not sell, distribute or lease your personal information to third parties unless we have your permission or are required by law to do so.
